Title

APPROVAL OF FINAL PARCEL MAP NO. 84006 - 4358 VIA PADOVA

Body

SUMMARY

John Meller and Li Qiong Tang, Trustees of the Meller-Tang Trust and sub-divider of Parcel Map No. 84006 (PM 84006), are requesting that the City Council approve PM 84006 for recordation by the Los Angeles County Recorder’s office. The Meller-Tang Trust parcel map will subdivide one existing 34,303 square foot (0.79-acre) parcel into two parcels (APNs: 8673-026-030 & 31) located at 4358 Via Padova. Proposed parcel 1 (8673-026-030) is approximately 19,567 square feet (0.45-acre) and contains an existing single-family dwelling. Proposed parcel 2 (8673-026-31) is approximately 14,736 square feet (0.34-acre) and will be sold to another owner for future development.

Pursuant to Sections 66458 and 66474.1 of the Subdivision Map Act, the approval of a final map is a ministerial action and cannot be denied if the final map is in substantial conformance with the conditionally approved tentative map and conforms to the requirements established by the Subdivision Map Act and local ordinance. The City Council is the decision making body for final maps and, according to the Subdivision Map Act, if the map conforms to all requirements, City Council must approve the map at the meeting at which it receives the map or at its next regular meeting.

Staff finds that the final PM 84006 is consistent with the provisions of the Subdivision Map Act and is in substantial conformance with the tentative map reviewed and approved by the Planning Commission on July 18, 2023.

ANALYSIS

Tentative Parcel Map (TPM) No. 84006

The existing parcel was merged from two parcels, previously known as lots 8 and 9 of Tract 9582, in 2002. The property has since sold and been developed with a single-family home. The property owner has requested to split the lot, effectively reversing the merger and intends to sell the remaining 14,763 square foot parcel known as parcel 2 (8673-026-031).

TPM No. 84006 was conditionally approved on July 18, 2023 by the Planning Commission to subdivide the above-mentioned parcel into two parcels. The final map is required to be approved by Resolution (Attachment A) within three (3) years of the approval date.

The intent of the map was to create a new parcel which could be sold to another owner for future development. The property currently contains an existing single-family home taking access to Via Padova from an existing driveway. The existing single-family home on parcel 1 (8673-026-030) will maintain all existing utility connections separate from parcel 2. Parcel 2 will be sold to a new owner for future development. At such time of future development, the new owner will be responsible for establishing separate driveway and utility access to Via Padova. Due to the future sale and development of parcel 2 and lack of proposed public improvements at the time of this subdivision, a Subdivision Improvement Agreement is not required as part of the Final Map approval. Development fees and public improvements associated with the development of this second lot will be assessed and collected when development occurs.

Map Review

Parcel Map No. 84006 (Attachment B) has been checked and found to be in substantial conformance with the conditionally approved tentative map, as well as with the Subdivision Map Act requirements. There is no subdivision improvement to accompany this final map as there are no proposed public improvements.

All submittals required for map recordation have been received and all fees have been paid.

RELATIONSHIP TO CITY PLANNING DOCUMENTS

Staff has evaluated the agenda item in relationship to the City’s strategic and visioning documents and finds the following City Planning Documents: General Plan.

CEQA REVIEW

In accordance with the California Environmental Quality Act (CEQA), the request to split and reorganize the existing parcel into two parcels is exempt from the provisions of CEQA pursuant to Section 15061(b)(3) as returning the previously merged residential lots to its original condition as two separate lots can be seen with certainty that there is no possibility that the activity may have a significant effect on the environment.  Furthermore, the intent of the subdivision is to accommodate the future construction of one single-family home, which is categorically exempt from CEQA pursuant to Section 15303 (Class 3) - construction or conversion of small structures.  The new lot is located in the Residential 13,000 zone, which allows construction of single-family homes, which would meet the criteria of the Class 3 exemption.
