AUTHORIZATION TO ENTER INTO A PROFESSIONAL SERVICES AGREEMENT WITH MICHAEL BAKER INTERNATIONAL FOR THE DESIGN AND PREPARATION OF PLANS AND SPECIFICATIONS FOR ACCESSIBILITY IMPROVEMENTS (FUNDING SOURCE: MEASURE M FUND)
Body
SUMMARY
Staff receives requests throughout the year to address Americans with Disabilities Act (ADA) needs. Over the past year, staff has received requests where ADA needs were identified in the Arbol Verde Neighborhood, along Northwestern Drive, Butte Street, First Street at Harvard Avenue (south side), and Indian Hill Boulevard and Bonita Avenue.
To prepare plans and specifications to implement these projects, staff recommends appropriating Measure M funds to contract with Michael Baker International to perform professional design services. These services include, but are not limited to, a right-of-way and topographic survey; potential easement mapping; right-of-way mapping; utility research; plans; specifications; and engineering estimates.
Staff recommends authorizing the City Manager to enter into a professional services agreement to complete plans and specifications for this citywide accessibility project, to allow staff to move forward with the advertisement for construction of various ADA improvements. These services shall not exceed $199,870.

ANALYSIS
The City of Claremont received requests to address Americans with Disabilities Act concerns in four different areas throughout the City. These locations include:
1. Arbol Verde Neighborhood (Mills Avenue and Brooks Avenue).
a. Review of 6 existing ADA ramps for upgrading to current standards.
b. Design of 6 new ADA ramps where none currently exist.
2. Northwest Whitman Avenue from Harrison Avenue to Santa Clara Avenue.
a. Review of 5 existing ADA ramps for upgrading to current standards.
b. Design of 4 new ADA ramps where none currently exist.
3. Butte Street from Duke Avenue to Pomona Court.
a. Design of 10 new ADA ramps where none currently exist.
4. Indian Hill Boulevard at Bonita Avenue.
a. Review of 4 existing ADA ramps for upgrading to current standards.
5. First Street at Harvard Avenue (south side).
a. Review of 2 existing ADA ramps for upgrading to current standards.
To make best use of available funding and staff resources, the Citywide Accessibility Improvements CIP project will be designed and implemented to include several locations within different City neighborhoods, using multiple annual budget allocations. To prepare plans and specifications to implement the different components/locations of this project, staff recommends using Measure M funds to contract with Michael Baker International to perform a right-of-way and topographic survey; potential easement mapping; right of way mapping; utility research; plans; specifications; and engineering estimates. The cost for these services shall not exceed $199,870.
Following the completion of the plans and specifications, a construction project will be advertised, and the remaining funding in the Capital Improvement Program budget will be used to fund the construction of the improvements. If there is a need for additional funding, staff will request an appropriation at the time a construction contract is awarded.

CEQA REVIEW
This item (Request for Appropriation of funds and Authorize the execution of a professional Engineering Services contract for the Design and Preparation of Plans and Specifications for ADA Improvements) is not subject to environmental review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and Section 15060(c)(3) (the activity is not a “project” as defined in section 15378). CEQA Guidelines Section 15378(b)(2), (4), and (5) excludes “continuing administrative ... activities,” “government fiscal activities, which do not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment,” and “administrative activities of governments that will not result in direct or indirect physical changes to the environment” from its definition of “project.”
Additionally, under CEQA Guidelines Section 15061(b)(3), it is covered by the general rule that CEQA applies only to projects that have the potential for causing a significant effect on the environment. Executing a professional engineering services contract will not have a significant effect on the environment because the action will not result in or lead to a physical change in Claremont. Therefore, no additional environmental review is needed.
