Body
SUMMARY
Olson Urban V - Claremont, LLC., the sub-divider (sub-divider) of Tract Map No. 83751 requests City Council approval of the final tract map for recordation by the Los Angeles County Recorder’s office. This tract map will subdivide the existing 3.05-acre lot at 1030 West Foothill Boulevard for residential townhome condominium purposes. The map conforms to existing Mixed Use 3 (MU3) zoning district development standards. The MU3 zone allows for mixed-use residential and commercial use with the approval of a Mixed Use District Development Plan (MUDDP).
Pursuant to Sections 66458 and 66474.1 of the Subdivision Map Act, the approval of a final map is a ministerial action and cannot be denied if the final map is in substantial conformance with the conditionally approved tentative map and conforms to the requirements established by the Subdivision Map Act and local ordinance. The City Council is the decision-making body for final maps, and if the map conforms to all requirements, it must approve the map at the meeting at which it receives the map or at its next regular meeting. A resolution approving the Final Tract Map, together with the Agreement for Completion of Public Improvements, which is an Exhibit to the Resolution is Attachment A to this report.
Staff finds that the final Tract Map No. 83751 (Attachment B) is consistent with the provisions of the Subdivision Map Act and is in substantial conformance with the tentative map approved by the Planning Commission on September 4, 2023 and by City Council on September 26, 2023. Minutes from the Planning Commission and City Council meetings are included in (Attachment C).

ANALYSIS
On March 24, 2022 the applicant submitted a preliminary application pursuant to Senate Bill 330 (2019-2020) - Housing Crisis Act of 2019 (SB 330) for a proposed, 56-unit townhome condominium development, including 12 live/work units. This process created a path forward for the processing of the tentative map.
Tract Map No. 83751 is located at 1030 West Foothill Boulevard and creates one mixed-use lot (3.05 acres) for 56 residential townhome condominium units, including 12 live/work units. With the Planning Commission’s approval of the tentative map, the Planning Commission also approved a Mixed Use District Development Plan (MUDDP) to allow mixed-use development on the project site, per Claremont Municipal Code (CMC) 16.040.070. The City’s General Plan designates the project site as Foothill Boulevard Corridor Mixed Use, and the zoning designation for the project is Mixed Use 3 (MU3), which allows for mixed-use residential uses and live/work use with the approved MUDDP. A copy of the submitted final map, which illustrates the parcel location and configuration, is attached.
The project has two vehicular access points to this project. One drive approach is located on Foothill Boulevard, serving approximately 28 residential townhome condominium units, including 12 live/work units, and the second drive approach is located on Towne Avenue, serving the remaining 28 residential townhome condominium units. Both drive approaches provide right turn-in and right turn-out movements.
Map Review
Tract Map No. 83751 has been checked and found to be in substantial conformance with the conditionally approved tentative map, as well as with the Subdivision Map Act requirements. The sub-divider has signed the subdivision improvement agreement and provided security guaranteeing the construction of all public improvements.
All submittals required for map recordation have been received by the City, along with the payment of fees.
Public Improvements
As part of the subdivision requirements, the subdivider will construct improvements both on-site and within the public right-of-way. Improvements within the public right-of-way include, but are not limited to, the construction of two sewer manholes and lateral tie-ins, the removal and replacement of sidewalks, curbs and gutters, landscaping and irrigation, and pavement restoration on Foothill Boulevard.
Additional public improvements are being constructed on the Towne Avenue side of the project frontage. However, this area within the public right of way is located in the City of Pomona’s jurisdiction. The City of Claremont and City of Pomona staff have been coordinating review efforts to review, approve, and permit these improvements.
RELATIONSHIP TO CITY PLANNING DOCUMENTS
Staff has evaluated the agenda item in relationship to the City’s strategic and visioning documents and finds that it applies to the following City Planning Documents: Council Priorities, Sustainable City Plan, and the General Plan.
CEQA REVIEW
Final Maps are ministerial projects and exempt from the requirements of the California Environmental Quality Act as stated in Section 15268 of the California Environmental Act Guidelines.
COUNCIL COMMITTEE/COMMISSION REVIEW
The tentative map was approved by the Planning Commission on September 4, 2023 and by City Council on September 26, 2023 (Attachment C).
