BIENNIAL AMENDMENT TO THE CITY OF CLAREMONT CONFLICT OF INTEREST CODE

SUMMARY
The Political Reform Act of 1974, Government Code Section 81000 et seq. (the “Act”), provides that certain municipal officials must disclose their economic interests. These officials are members of the City Council, members of the Planning Commission, City Manager, City Attorney, City Treasurer, and other City officials who manage public investments.
The Act also requires the City to determine and designate which of its other officials, commission members, and employees have duties which involve potential conflicts of interest. The Conflict of Interest Code, adopted by resolution of the City Council, provides for the disclosure of those designated employees’ assets and income which may be materially affected by their official actions, and further provides that, in certain circumstances, an individual be disqualified from acting to avoid a conflict of interest.
The Act requires the City to biennially review and update, if necessary, its Conflict of Interest Code. The City Council, at its meeting of May 12, 2026, directed the City Attorney to conduct a review of the current Code to determine whether revisions are necessary, revise the Code based upon such review, and submit the amended Conflict of Interest Code to the City Council, if changed.
The removal of obsolete positions, creation of new positions, and retitling of existing positions necessitate a number of changes in the City’s Code as outlined in the charts included in the Analysis section of this report. A resolution approving and adopting an amended Conflict of Interest Code is included as an Attachment to this report.
RECOMMENDATION
Recommended Action
Staff recommends the City Council adopt A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CLAREMONT, CALIFORNIA, APPROVING AND ADOPTING AN AMENDED CONFLICT OF INTEREST CODE PURSUANT TO THE POLITICAL REFORM ACT OF 1974.

FINANCIAL REVIEW
The cost to complete this staff report is estimated at $770. This cost consists of staff time and is included in the operating budget of the Administrative Services Department.
ANALYSIS
The Political Reform Act of 1974, Government Code Section 81000 et seq., requires all public agencies to adopt and maintain a conflict of interest code. The Act further requires agencies to biennially review and update their conflict of interest codes as directed by the code-reviewing body or when necessitated by changed circumstances (Sections 87306 and 87306.5).
At its May 12, 2026 meeting, the City Council directed the City Attorney to review the current Conflict of Interest Code. Having completed the review, and finding that new positions should be added, a resolution has been prepared adopting an amended Conflict of Interest Code for City Council approval and adoption (Attachment).
The proposed revisions to the Code are based on the removal of obsolete positions, addition of new staff positions, and to reflect title changes as outlined in the charts below:

The proposed amendment adds the new positions referenced and assigns disclosure categories in accordance with the job description and evaluation of duties for each position.
RELATIONSHIP TO CITY PLANNING DOCUMENTS
Staff has evaluated the agenda item in relationship to the City’s strategic and visioning documents and finds it relates to the City’s General Plan and the 2026-28 Budget.
