AUTHORIZATION TO ENTER INTO A THREE-PARTY AGREEMENT FOR CLAREMONT MCKENNA COLLEGE ROBERTS CAMPUS SPORTS BOWL PUBLIC SAFETY OFFICE SEWER SERVICE (CLAREMONT/UPLAND/CLAREMONT MCKENNA COLLEGE) (FUNDING SOURCE: APPLICANT - CLAREMONT MCKENNA COLLEGE)
Body
SUMMARY
Claremont McKenna College (CMC) is completing construction of the Roberts Campus Sports Bowl. Most of the project lies within the City of Upland, in San Bernardino County. The Public Safety Office restrooms, kitchenette, and janitor sink are in the City of Claremont, in Los Angeles County, outside the City of Upland’s jurisdiction.
Wastewater from fixtures within these facilities will be discharged to an existing and readily available City of Upland sewer main, on Arrow Route. Extending the City of Claremont’s sewer system to serve this limited fixture count was determined to be cost prohibitive.
The San Bernardino County Local Agency Formation Commission (LAFCO) and the Los Angeles County LAFCO have both confirmed that the appropriate path is an agreement between two public agencies, processed by the San Bernardino County LAFCO, as the LAFCO of the agency providing the service.
As part of this process, the agreement was prepared as a three-party instrument among the City of Upland, the City of Claremont, and Claremont McKenna College to memorialize the facts and terms of this connection.
RECOMMENDATION
Recommended Action

All expenses associated with the preparation and legal review of this agreement will be borne by the applicant, Claremont McKenna College.
ANALYSIS
Claremont McKenna College is completing construction of the Roberts Campus Sports Bowl. Most of the project lies within the City of Upland, in San Bernardino County. A limited portion of the parking structure, specifically, the Public Safety Office restrooms, kitchenette, and janitor sink, is in the City of Claremont, in Los Angeles County, outside the City of Upland’s jurisdiction.
Wastewater from the fixtures within these facilities will be discharged to an existing City of Upland sewer main, at Arrow Route and College Park Drive, and ultimately, to the Inland Empire Utilities Agency (IEUA) treatment facilities. Claremont’s closest sewer main is located on Sixth Street, west of Claremont Boulevard, approximately 800 feet away from the Public Safety Office. Extending the City of Claremont’s closest sewer main to serve this limited fixture count was determined to be cost prohibitive.
Because the area to be served is outside of the City of Upland’s jurisdiction, the standard Government Code Section 56133(b) path (service in anticipation of annexation) is not available. The San Bernardino County Local Agency Formation Commission (LAFCO) and the Los Angeles County LAFCO have both confirmed that the appropriate path is an agreement between two public agencies under Government Code Section 56133(e), processed by the San Bernardino County LAFCO, as the LAFCO of the agency providing the service. The out of agency/exemption application and associated fee have been already submitted to the San Bernardino County LAFCO.
The Inland Empire Utilities Agency (IEUA) and the Regional Sewage Service Contract separately require IEUA Boad approval for extra territorial service. IEUA will require the San Bernardino County LAFCO determination as part of its Board package.
The next San Bernardino LAFCO Commission hearing is November 18, 2026. LAFCO staff has indicated that the item can be placed on that agenda, if the agreement, signed by at least one of the two cities, is received by November 10, 2026. The City of Upland City Council considered and approved the agreement at its October 26, 2026, meeting. This date meets the LAFCO deadline. Claremont’s timely action is also important because LAFCO and IEUA approvals are necessary for the certificate of occupancy of the Claremont side fixtures, which CMC is expected to obtain this fall.
The agreement was prepared as a three-party instrument among the City of Upland, City of Claremont, and Claremont McKenna College to memorialize the facts and terms of this connection. Claremont’s role is to authorize the extra territorial connection within its boundary. Once LAFCO and IEUA approve the extra territorial service, the agreement will be recorded in Los Angeles County so that it runs with the land.
