SUMMARY
The developer of Tract Map No. 82123 has completed all subdivision improvements associated with the development as required in the map’s Subdivision Improvement Agreement. The developer requests that the City Council release the Performance and Improvement bonds associated with the tract.
Staff finds that, per the Subdivision Improvement Agreement for the tract, the time frame required to post the performance bond has been fulfilled. Therefore, staff recommends the City Council release the performance and improvement bonds.

Recommended Action
Staff recommends the City Council accept and approve the public improvements and release the applicable improvements bonds for Final Tract Map No. 82123.

FINANCIAL REVIEW
If approved, the following bonds will be released:
• Tract Map No. 82123 Intract Performance Bond #800123202 in the amount of $747,184.
According to the Subdivision Improvement Agreement, the bonds may be released one year after the completion and acceptance of said improvements by the City.
The staff cost to prepare this report is estimated at $672 and is included in the operating budget of the Community Development Department.
ANALYSIS
Tract Map No. 82123 is located at 511 Colby Circle and creates two residential lots for the originally approved 96 condominium units. A copy of the submitted final map, which illustrates the parcel location and configuration, is included as Attachment A.
A Subdivision Improvement Agreement was approved along with the Final Tract Map approval. Based on the approved Subdivision Improvement Agreement, the performance and improvement bonds are eligible for release one year after the acceptance of the off-site improvements; however, a partial release may be granted prior to the one-year guarantee period.
The final inspection of the improvements was conducted on October 15, 2024. Therefore, a full release of the performance bond can be granted after October 15, 2025. A partial release was requested by the developer prior to October 15, 2025, and after review by the Community Development Department, a partial release of 80 percent was granted on May 1, 2025.
Map Review
The City Council approved the Final Tract Map No. 82123 by resolution and entered into a Subdivision Improvement Agreement with the developer on June 8, 2021 (Attachment B).
Public Improvements
As part of the subdivision requirements, the developer has constructed improvements both on-site and within the public right-of-way. Improvements within the public right-of-way include, but are not limited to, handicap ramps, sidewalks, curbs, gutters, streetlights, and landscaping.
These improvements have been completed according to the Subdivision Improvement Agreement, consistent with the approved plans. The installation of these improvements has been inspected and accepted by the City.
To close this project, the developer is now requesting the release of the Intract Performance and Intract Improvement bonds.
In addition to the Subdivision Improvement Agreement, the City also entered into a Deferred Improvement Agreement with the developer on June 8, 2021. As part of the Deferred Improvement Agreement, a $500,000 bond was posted in accordance with Mitigation Measure K, which obligated the Subdivider to provide financial security for a potential traffic signal at the intersection of Indian Hill Boulevard and Colby Circle. Based on Resolution 2020-66, the intersection conditions shall be evaluated at the developer’s expense at the half-way point and at the conclusion of the five-year bonding period. The end of the five-year bonding period is in December 2026. At that point, the release of the Deferred Improvement Agreement bond of $500,00 shall be evaluated.

Staff has evaluated the agenda item in relationship to the City’s Planning Documents and finds that it does not apply.
