APPROVAL OF FINAL PARCEL MAP NO. 83881 FOR SENATE BILL 9 SUBDIVISION PURPOSES

SUMMARY
The property owner of 1088 Cascade Place requests City Council approval of the Final Parcel Map No. 83881 for recordation by the Los Angeles County Recorder’s office. This parcel map will subdivide the property into two parcels under Senate Bill 9 (SB 9).
Pursuant to Government Code Sections 65852.21 of the Subdivision Map Act, the approval of a final map is a ministerial action and cannot be denied if the final map is in substantial conformance with the approved tentative map, conforms to the requirements established by Senate Bill 9, and is not found to create a specific, adverse impact by the City Building Official.
Staff finds that the final Parcel Map No. 83881 (Attachment A) is consistent with the provisions of the Subdivision Map Act, is in substantial conformance with the tentative map approval dated June 26, 2023 (Attachment B), and does not create a specific, adverse impact.
RECOMMENDATION
Recommended Action
Staff recommends the City Council:
A. Approve Parcel Map No. 83881 for Senate Bill 9 subdivision purposes; and
B. Find this item is exempt from environmental review under the California Environmental Quality Act (CEQA).

ALTERNATIVE TO RECOMMENDATION
The City Council may only deny the proposed subdivision under SB 9 if the City Building Official makes a written finding, based upon a preponderance of evidence, that the proposed housing development would have a specific adverse impact, as defined by Government Code Section 65589.5, upon public health and safety or the physical environment and for which there is no feasible method to satisfactorily mitigate or avoid the specific adverse impact. Denial of the Map without the Building Official’s written findings would directly conflict with state law.

The staff cost to prepare this report is estimated at $1,184 and is included in the operating budget of the Community Development Department.
ANALYSIS
Background
Senate Bill 9 was signed into law by the state in September of 2021 and went into effect January 1, 2022. SB 9 requires local agencies to ministerially approve the subdivision of a parcel within single-family residential zones into two parcels. SB 9 limits the requirements and development standards the City may impose. The City may not require the construction of off-site improvements or require the applicant to enter into a subdivision improvement agreement as a condition of approving a lot split under this law. The provisions of SB 9 override any conflicting provisions of the Subdivision Map Act.
Staff received a request to split an existing 16,819 square foot lot with an existing dwelling unit and develop both proposed parcels pursuant to SB 9 on the property located at 1088 Cascade Place (APN 8303-009-026) within the RS-10,000 zone. The proposed improvements include a new 3,195 square-foot two-unit development on the southern parcel. The existing single-family residence will remain.
Map Review
Staff reviewed and processed the subdivision pursuant to SB 9, adhering to the regulations and limitations of the law.
Parcel Map No. 83881 has been checked and found to be in substantial conformance with the conditionally approved tentative map, as well as with the Subdivision Map Act requirements.
All submittals required for map recordation have been received by the City, along with the payment of fees.
The City Building Official did not determine any findings that would prevent the subdivision under SB 9.
RELATIONSHIP TO CITY PLANNING DOCUMENTS
Staff has evaluated the agenda item in relationship to the City’s strategic and visioning documents and finds that it applies to the following City Planning Documents: General Plan.
CEQA REVIEW
Final Maps are ministerial projects and exempt from the requirements of the California Environmental Quality Act as stated in Section 15268 of the California Environmental Act Guidelines.
